General terms and conditions of sale
1. Presentation and scope of application
These terms and conditions of sale are intended to define the contractual relationship between ORIGINES & SAVEURS, Drève de Nivelles n° 28/B5, 1150 Brussels, Belgium Tel: +32 478 11 45 69 - Company / VAT number: BE0680588028 and the individual buyer (customer), and the terms and conditions applicable to any purchase made through the commercial website of Origines & Saveurs, www.originesetsaveurs.com. An individual is a natural person who uses the products for his personal needs and those of his family.
These general terms and conditions of online sale define the terms and conditions under which the customer orders, purchases and obtains delivery of the products presented and sold by Origines & Saveurs on the website as part of a distance selling contract.
Origines & Saveurs specifies that distance selling on the Site is exclusively reserved for consumers of legal age, i.e. any natural person acting for purposes that do not fall within the scope of his or her commercial, industrial, craft or liberal activity, as well as legal entities for their needs other than those relating to their activities, hereinafter referred to as "the Customer". Any acquisition that does not comply with this limitation shall engage the responsibility of the customer and/or his representatives.
The resale of products purchased on the site is strictly forbidden.
The acquisition of a good through the present site implies an acceptance without reserve by the buyer of the present conditions of sale.
These general terms and conditions of sale shall prevail over any other general or special terms and conditions not expressly approved by Origines & Saveurs.
The present general terms and conditions of sale can be consulted on the website when the order is placed. The general terms and conditions of sale can also be consulted from a tab at the bottom of the home page of the site.
Before validating the order of the products, the customer declares to have taken knowledge of the general conditions of sale.
Validation of the order by the customer implies full acceptance of the general terms of sale in force on the site on the day of the order. The general terms and conditions of sale shall be the only ones applicable to the sale of products on the Site.
Origines & Saveurs may modify the terms and conditions of sale at any time. Origines & Saveurs therefore invites the Customer, before each new order, to carefully reread the general conditions of sale in force on the Site.
2. Offer
The products offered to the Customer are those shown on the Origines & Saveurs website when the order is validated, within the limits of available stocks and subject to the proper functioning of the website, or in promotional offers published on the Origines & Saveurs website.
Each product offered on the website is presented with its name, its composition and its price. Some products are accompanied by photographs. Origines & Saveurs shall not be held responsible for any slight variations between the product and its representation on the website.
3. Prices
The products are supplied at the prices displayed on the site at the time of validation of the order.
The prices are expressed in euros and are displayed inclusive of all taxes including VAT.
Prices do not include delivery costs.
4. Sales/Ordering
4.1 The Products are offered for sale while stocks last.
Our product offers are valid as long as they are visible on the site, within the limits of available stocks.
In the event that a product is not available after you have placed your order (stock error or other case), we will inform you by e-mail or telephone. We will then offer you the following options
reimbursement of the missing product(s) by credit card or Paypal.
OR a refund in the form of a voucher
OR replacement with products of your choice of equivalent value to the missing products
Validation will be suspended until you respond.
4.2 Minimum quantity
The minimum quantity per order is fixed at one product.
4.3 Ownership of products
Origines & Saveurs retains ownership of the products delivered until full payment of the invoices and reserves the right to suspend delivery in the event of late payment and until the debtor's account has been settled in full.
4.4 Validation of the order
The customer agrees to provide the information necessary to process the order, in particular, name, first name, address, telephone numbers (landline and/or mobile), email address, delivery address, and the billing address if different.
The information provided by the customer when entering the order is binding. In the event of an error by the Customer in the choice of products or in the wording of his/her personal information, Origines & Saveurs shall not be held responsible for these errors and their consequences.
All orders are summarised before the Customer is invited to validate the order.
The site's ordering system allows the customer to go back over his or her order to modify it and/or correct any errors, before finally validating it.
The customer places a definitive order by clicking on the "Proceed to checkout" button and by ticking the box accepting the general conditions of sale. Validation of the order implies acceptance of the price and characteristics of the products.
Origines & Saveurs shall send confirmation of the order by e-mail.
Origines & Saveurs is entitled to refuse any order for a legitimate reason, in particular in the event of proven financial difficulties on the part of the Customer - payment incidents - foreseeable problems affecting delivery, orders placed in bad faith by the Customer.
5. Payments
Payment of the order is made in euros by bank card (debit card, blue card or credit card). After validation of the order, the customer is directed to the secure site of his banking/financial institution guaranteeing the preservation of the confidentiality of the card numbers by protection and encryption procedures.
The customer must note the information on his or her bank card, in particular its name, number, expiry date and cryptogram, as well as any other element necessary for payment.
The Customer's bank account shall be debited when the order is confirmed by the Customer.
Origines & Saveurs also gives the customer the option of paying for their order via PayPal, Visa, IDeal, Google Pay and Apple Pay.
The invoice and the credit card receipt are sent by Origines & Saveurs in the order confirmation email.
6. Deliveries and delivery costs
Deliveries are made to the address indicated on the order form which can only be within the agreed geographical area.
The delivery costs in Belgium and in the European Zones (1 and 2 below) are those in force on the day the order is transmitted, as they appear on the tariffs applicable on that date.
In case of delivery outside Belgium, you are responsible, as the importer, for the payment of all customs duties, taxes or other charges imposed on the arrival of the goods.
The transport and delivery costs depend on the following geographical zones and order amounts:
Zone BE: Belgium
Zone 1 : France, Spain, Germany, Netherlands, Luxembourg, Italy, Austria, Switzerland, Andorra, Monaco
Zone 2 : Other European countries
Zone 3 : Other countries

(Amounts include VAT. The free delivery is the minimum order amount for which the delivery costs are offered).
7. Delivery times
Origines & Saveurs endeavours to deliver in Belgium within five to seven (5 to 7) working days following receipt of the order, to the address of your choice. The risks of loss and deterioration of the products are transferred to you upon delivery.
In any event, delivery within the time limit shall only be made if the Customer is up to date with his obligations towards Origines & Saveurs.
8. Disputes
Receipt of the Order :
The Client, or where applicable the recipient, is responsible for checking the condition of the products delivered.
In the event of shortages, loss or damage, the Customer must make a claim to the carrier by registered letter with acknowledgement of receipt within three (3) working days of receiving the products in the order.
The Customer shall send a copy of this letter by email or by letter to Origines & Saveurs.
10. Right of retraction for customers
Pursuant to the provisions of the Consumer Code, the Customer has a period of fourteen (14) calendar days from the date of receipt of the products to exercise his/her right of retraction, without having to justify his/her reasons or pay any penalty, with the exception of the cost of returning the products ordered on the internet in accordance with the conditions of the present general conditions of sale. However, Origines & Saveurs sells perishable foodstuffs, which falls within the exceptions defined by the CDE. Origines & Saveurs has therefore decided not to provide a right of retraction.
11. Return of products
In the event of a hidden defect or non-conformity of the products delivered, the Customer shall return the products, at his/her own risk, to Origines & Saveurs in compliance with the following cumulative conditions:
The products concerned must be in the same condition as the carrier delivered them.
The products must be returned in their original packaging, or in a new, sufficiently strong and properly sealed package if the original packaging has been damaged,
The order number, confirmation email, invoice and delivery note must be attached to the returned products.
The customer or the recipient must keep a proof of sending the returned products.
The customer is responsible for the return shipping costs.
12. Applicable law
This contract is subject to Belgian law. The language of this contract is French. In case of dispute, the court of Brussels is the only competent court.
13. Liability - Limitation of liability
The Customer is solely responsible for the choice of products, their conservation and their use. Origines & Saveurs shall not be held liable for any damage arising from this.
Origines & Saveurs shall not be held responsible for any failure to comply with the laws or regulations in force in the country of delivery, Origines & Saveurs being solely responsible for compliance with Belgian regulations relating to the products.
Except in the case of proof of fault, Origines & Saveurs shall not be held responsible for any damage of any kind that may result from the misuse of the identifiers or the ordering process. Origines & Saveurs shall not be held liable for any risks inherent in the use of the Internet, such as the suspension of the service, an intrusion or the presence of a computer virus.
Neither Origines & Saveurs nor the Customer shall be held responsible for any failure to perform due to force majeure beyond their control, including but not limited to war, riot, insurrection, interruption of transport, import or export problems, strikes, lock-outs, shortages, fire, earthquakes, storms or floods.
Origines & Saveurs shall inform the Customer by any appropriate means of the existence of such an event in order to allow the Customer to cancel the order in writing.
Origines & Saveurs shall not be held liable in the event of non-performance or poor performance of the contract due to the fault of the Customer, or to the insurmountable and unforeseeable act of a third party to the contract, or due to a case of force majeure.
The responsibility of Origines & Saveurs is strictly limited to the online sale of products presented on the website.
In any event, and whatever the reason for the liability of Origines & Saveurs, its liability shall be limited to the lower of the following two sums: the amount of the direct loss suffered by the customer or the price of the order.
14. Intellectual property
The general structure of the Website and all its components, in particular the texts, data, graphic charter, animated or non-animated graphic elements, images, photos, product names, sounds and videos are protected by the laws on intellectual property, in particular by copyright, designs and models and trademark law. They are the exclusive property of Origines & Saveurs. Any representation, use or reproduction of all or part of the Website and/or its components without the express prior authorisation of Origines & Saveurs is prohibited.
15. Information on the collection of personal data
Origines & Saveurs undertakes to respect the confidentiality of the personal data provided by the Customer on the Site and to process them in accordance with the provisions of the laws in force.
The information collected by Origines & Saveurs is processed electronically and is strictly intended for the following purposes: the management of orders and shopping baskets, the monitoring of customer relations, the management of subscriptions to the newsletter distribution list, monitoring for statistical purposes to enrich the editorial content and adapt it to the needs of customers, the management of requests for access, rectification and opposition rights and the management of unpaid bills and disputes.

16. Applicable law - Jurisdiction
The present general terms and conditions of sale are subject to Belgian law.
In the absence of an amicable agreement, the dispute will be brought before the competent Belgian courts.
